Toni Quintero - 2 - 12 January 2005
Harney Lane Migrant Center
Due to the failure to submit the required reports pursuant to Section 13267 of the California Water Code,
staff's usual next step is to recommend to management that civil liability(i.e., monetary penalties)be
assessed against the Discharger. As of 7 January 2005, the maximum liability for the delinquent
report listed above is $250,000, as shown in the enclosed table.
However, staff will not recommend that the Executive Officer issue an Administrative Civil Liability
Complaint if the delinquent reports are submitted by 20 February 2005. Alternatively, you may submit
a report by 20 February 2005 stating the changes that you will make to ensure that future monitoring
reports are submitted in a timely manner. Note that submittal of this alternate report will not provide
protection against issuance of civil liability if future monitoring reports are again delinquent. Finally, the
fourth quarter monitoring report for 2004 is due by 20 January 2005.
If any or all of these reports are not received by the above dates, staff will recommend the issuance of an
Administrative Civil Liability Complaint. If you have any questions about this Notice of Violation or
the report requirements,please call me at(916) 464-4835 or Timothy O'Brien at (916) 464-4616.
WENDY WYELS, Su ervis r
p
Title 27 and WDR Units
Enc: WDRs Order No 95-176
Potential Liability Table
Standard Provisions
cc: Mike Huggins, San Joaquin County Environmental Health Department, Stockton
