As of 7 January 2005, the maximum liability for the delinquent <br /> report listed above is $250,000, as shown in the enclosed table. <br /> However, staff will not recommend that the Executive Officer issue an Administrative Civil Liability <br /> Complaint if the delinquent reports are submitted by 20 February 2005. Alternatively, you may submit <br /> a report by 20 February 2005 stating the changes that you will make to ensure that future monitoring <br /> reports are submitted in a timely manner. Note that submittal of this alternate report will not provide <br /> protection against issuance of civil liability if future monitoring reports are again delinquent. Finally, the <br /> fourth quarter monitoring report for 2004 is due by 20 January 2005. <br /> If any or all of these reports are not received by the above dates, staff will recommend the issuance of an <br /> Administrative Civil Liability Complaint.
