Item No . _4 <br /> PC : 7-6-89 <br /> MS-89-72 <br /> Page 3 <br /> STAFF ANALYSIS <br /> BACKGROUND : <br /> The applicant proposes to subdivide a 21 . 8-acre parcel into two <br /> parcels. Parcel 1 is to be a 10-acre homesite for the owner- <br /> operator ; Parcel 2 will contain 11 . 8 acres . The General Plan <br /> designation is Agriculture . The zoning is GA-40 (General <br /> Agriculture ) , which allows for agricultural uses with a minimum <br /> lot size of 40 acres . The homesite provision is an exception to <br /> the 40-acre minimum lot size requirement . Ordinarily, homesite <br /> parcels are sized under three acres . However, this parcel is <br /> under Williamson Act contract , which requires a minimum parcel <br /> size of 10 acres . Therefore, the result of providing a homesite <br /> parcel for a 21 . 8-acre parcel under Williamson Act contract is a <br /> 10-acre parcel and an 11 . 8-acre parcel . <br /> The applicant owns two other properties within one mile of the <br /> project site : a 13-acre parcel , APN 011-180-08 , and a 23-acre <br /> parcel with a house on it , APN 011-180-13 . <br /> POLICY CONSIDERATIONS : <br /> Section 9-4104 (b) ( 1 ) states that "one parcel of land may be <br /> created for the purpose of financing a residence for not more <br /> than one ( 1 ) owner-operator of an agricultural enterprise . " <br /> Staff is asking the Plannning Commission to detemine whether or <br /> not this project meets the intent of the homesite provision of <br /> the Planning Title . <br /> Staff believes this project does not meet the intent of the home- <br /> site provision for two reasons . <br /> First , the division of land is not required to acquire financing. <br /> The difference between a 10-acre parcel and a 22-acre parcel is <br /> not likely to change a financial institution' s decision to <br /> finance the construction of a home . <br /> Second, the applicant: does not need to create a homesite parcel <br /> because he already has a house within one mile of this property. <br /> This project does not meet the intent of the owner-operator/home- <br /> site provision of the Planning Title because the homesite is not <br /> necessary and a division of land would not improve the appli- <br /> cant ' s ability to finance the construction of a home . Also, <br /> further fragmentation of the agricultural property is contrary to <br /> the intent of preserving larger parcels more suitable for econo- <br /> mic farming activities . <br />
