SOIL BORING ACCESS AGREEMENT <br /> 1451 Hulsey Way, Manteca. California <br /> Advanced GeoEnvironmental, Inc. (AGE) is hereby granted permission to perform a subsurface <br /> investigation at 1451 Hulsey Way, Manteca, California on only that portion designated as Lot I <br /> as depicted on the attached"Exhibit A" (the site). AGE is not granted permission to perform any <br /> subsurface investigations on Lot 2 as depicted on Exhibit A. The subsurface investigation is <br /> being conducted to assess subsurface environmental conditions based on historical site usage. <br /> Investigatory activities to be conducted on the site will consist of advancing a series of borings <br /> for the collection of soil and ground water samples. Borings will be advanced to depths of <br /> approximately 20 feet below surface grade to collect soil samples. At the conclusion of the <br /> investigatory activities, the borings will be properly abandoned under permit with the original <br /> grade restored and the surface properly repaired to preexisting conditions. <br /> All expenses for the subsurface investigation as related to the activities at the 1451 Hulsey Way <br /> site shall be paid by the Bank of the West and will be conducted under permit in a timely manner <br /> upon approval by the San Joaquin County Environmental Health Department(SJCEHD). <br /> All affected tenants of the site will be given 48 hours notice prior to the initiation of field <br /> activities, which. will be conducted in a manner to minimize disruption of normal site activities. <br /> AGE shall maintain such insurance as required pursuant to section 16.5 of the Ground Lease <br /> between Spreckels Station LLC and Bank of the West.. A copy of which is attached as "Exhibit <br /> B". AGE shall not enter upon the site until after Spreckels Station LLC has received a <br /> Certificate of Insurance naming Spreckels Station LLC as an additional insured pursuant to <br /> Exhibit B. <br /> C'arlo t&mpson,��� Date �0 1151—n� <br /> Spreckels Station, LLC <br />
