Box 8038 <br /> Stockton, CA 95208 <br /> NOTICE OF VIOLATION FOR LATE REPORTS, MOR,4DA PROD UCE, LINDEN, SAN <br /> JOAQUIN COUNTY <br /> Waste Discharge Requirements (WDRs) Order No. R5-2003-0178 was issued to Morada Produce on <br /> 5 December 2003. The Provisions section of the WDRs requires submittal of specific technical <br /> reports. To date, Morada Produce has failed to submit the reports and is therefore in violation of its <br /> WDRs. <br /> On 13 April 2004, a Notice of Violation (NOV) was issued for failure to submit the reports. A <br /> summary of the missing reports is presented below. <br /> Provision Due Date Report Description <br /> G.2.a 1/5/04 Either a Notice of Non-Applicability, a No Exposure Certification, or a Notice <br /> of Intent to Comply with State Board Water Quality Order No. 97-03-DWQ. <br /> G.2.b 2/1/04 A technical report describing how wastewater pond inflows and supplemental <br /> irrigation flows will be metered. <br /> G.2.c 2/1/04 Operation and Maintenance Plan for the wastewater treatment facility, <br /> wastewater storage pond, and land application area. <br /> By 9 December 2004, Morada Produce shall submit the overdue technical reports described in the <br /> table above. <br /> This is the second NOV issued for failure to submit required reports. Staff does not have the authority <br /> to grant time extensions to WDRs that have been adopted by the Regional Board. Failure to comply <br /> with timelines set forth in WDRs may lead to enforcement actions. <br /> The WDRs require that all monitoring and technical reports be submitted pursuant to Water Code <br /> Section (CWC) 13267, which states, in part: <br /> "In conducting an investigation specified in subdivision (a), the regional board may require <br /> that any person who has discharged, discharges, or is suspected of having discharged or <br /> discharging, or who proposes to discharge waste within its region, or any citizen or <br /> California Environmental Protection Agency <br /> �a Recycled Paper <br />
