Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />February 21, 2020 <br /> Facility Address: <br /> 24588 S MacArthur Dr, Tracy <br /> Facility Name: <br /> Tracy Somg Tech <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 8 HSC 25505(a)(4) Failed to submit a training program or program is not reasonable or adequate for facility. <br />A training program was not submitted. <br />Training programs for all employees and annual training, including refresher courses, shall include familiarity with <br />the facility's Emergency response plans and procedures in the event of a release or threatened release of a <br />hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />These training programs may take into consideration of each employee. Immediately prepare or update the facility's <br />training program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br />upload the correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br /> 9 HSC 25508(a)(1) Failed to annually review and certify that the business plan is complete, accurate, and up to date. <br />The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br />System (CERS) annually. The business took over the business in August of 2019. A submittal was not made for <br />2019 and 2020. <br />The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted <br />beginning November 1 of the previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the <br />correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br />Employee training records were unavailable for review at time of inspection. <br /> The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual <br />refresher training.
