• The subject parcel does not currently provide public access , and the proposed <br /> project is for a private craft distillery operation . The proposed project will utilize <br /> only existing structures , within an existing disturbed area . As such , the <br /> development will not result in reduced public access . <br /> 6 . The development will not expose the public to increase flood hazards . <br /> • The project site is located in the 100 -year AE flood designation , and includes the <br /> conversion- of existing buildings totaling 59 , 225 square feet within an existing 7 - <br /> acre disturbed portion of two (2 ) parcels totaling 6 , 933 . 1 acres . No new buildings <br /> are proposed . If approved , any new development , including conversion of existing <br /> structures in the 100 -year AE flood designation area will have to comply with <br /> Development Title Section 9 - 1605 regarding flood hazards . Compliance with this <br /> section will be reviewed by the Department of Public Works . <br /> 7 . The development will not adversely impact agricultural lands or increase the potential for <br /> vandalism , trespass , or the creation of public or private nuisances on private or public land . <br /> • The proposed project site is located within a 7- acre existing developed area , north <br /> of State Route 4 within two (2 ) parcels totaling 6933 . 1 acres . The remainder of the <br /> parcel is currently in agricultural production , which will remain . The conversion of <br /> the existing structures totaling 59,225 square feet is not anticipated to adversely <br /> impactagriculturallands -- or be a nuisance . In addition , the project area will be <br /> fenced so as not to increase the potential for vandalism or trespass . <br /> 8 . The development will not result in the degradation or impairment of levee integrity . <br /> • The proposed project area is located within Reclamation District 2040 (Victoria <br /> Island ) property . The proposed project includes the conversion of existing <br /> structures , totaling 59 , 225 square feet . The previous asparagus packing facility will <br /> be replaced by the distillery . Therefore , the proposed project will not result in the <br /> degradation or impairment of levee integrity . <br /> 9 . The development will not adversely impact navigation . <br /> • The proposed project will not bR - located in an area that impacts access to the <br /> adjacent levee or nearby waterways , and will not adversely impact navigation . <br /> 10 . The development will not result in any increased requirements or restrictions upon agricultural <br /> -practices in the primary zone, <br /> • The subject parcel has a General Plan designation of General Agriculture (A/ G ) , and a zoning <br /> of AG -80 ( General Agriculture with an 80 - acre minimum ) . The Agricultural Processing - Food <br /> Manufacturing use type may be conditionally permitted in the AG -80 zone subject to a Use <br /> Permit application . As such , the proposed project will not impact the current zoning or <br /> General Plan designation . Furthermore , the San Joaquin County Right-To- Farm Ordinance <br /> ( Section 6-9004 [3] ) recognizes and supports the right to farm agricultural lands in a manner <br /> consistent with accepted customs , practices , and standards ; and has determined that <br /> inconveniences or discomforts associated with such agricultural operations or activities <br /> shall not be considered a nuisance . As a result , the proposed project will not result in any <br /> increased requirements or restrictions upon agricultural practices in the Primary Zone . <br /> PA- 1800071 — Previously Approved Findings 30 <br />
