I understand that you are probably busy and I appreciate your help. <br /> Since my last email, I have been advised by the emergency response section of DTSC that they are not able to <br /> respond at this time unless the owner provides written permission for them to respond or until 30 days has passed <br /> and the owner has not complied with the October 4, 2007 Notice to Abate issued by EHD. <br /> Regardless of if the owner hires a private contractor or if the work is done by DTSC, the EHD has determined the <br /> following: <br /> 1) The apparent nature and scope of the hazards at the site may pose an imminent threat to the adjacent <br /> populated residential areas and elementary school and so an immediate and timely abatement of the hazards is <br /> warranted at this time. <br /> 2) At this time, our department does not have the appropriate staff resources, technical expertise, or <br /> technical capabilities to adequately supervise the remedial action at the site. <br /> 3) The release of the waste is of a sufficiently complex nature or may present such a significant potential hazard <br /> to human health or the environment that it should be referred to the DTSC. <br /> Therefore, the EHD is formally referring the oversight of the remedial actions at this site to the DTSC.
