1 2 . Defendant (s ) and any agent, employees , representatives <br /> 2 and all persons, corporations or other entities acting by, <br /> 3 through, under, or on behalf of defendant( s ) and all persons in <br /> 4 concert with or participating with said defendant (s ) with actual <br /> 5 or constructive knowledge of this injunction, shall be permanently <br /> 6 enjoined from engaging in or performing directly or indirectly, <br /> 7 any of the following acts : <br /> a (a ) Receiving hazardous wastes without having a waste faci- <br /> a lity permit in violation of Health and Safety Code §25201. <br /> 10 ( b) Transporting and disposing of hazardous wastes to unli- <br /> 11 censed facilities and at unauthorized points in violation of <br /> 12 Health and Safety Code §25189. 5 . <br /> 13 (c ) Violating Health and Safety Code §25191 (a ) (5 ) , <br /> 14 525191(c) ( 2 ) , 525191 (d) (1 ) , and 525191 (d) ( 2 ) . <br /> 15 Attached as Exhibit A are the above mentioned Health and <br /> 16 Safety Code sections . <br /> 17 3 . Defendant shall allow any representative of the <br /> 18 California Department of Health Services to examine the premises, <br /> 19 books, and records relevant to the defendant' s surplus, sales, and <br /> 20 storage business during daylight hours . <br /> 21 The parties do hereby stipulate to the entry of the Order and <br /> 22 Final Judgment recited above.
