Gordon and the Bernice K. Gordon Revocable <br /> Trust (The "Respondent") is no longer able to complete the tasks required by Imminent <br /> and Substantial Endangerment Determination and Order(Order), I&SED 07/08-005. <br /> DTSC recognizes the Respondents efforts to implement the Plan, and comply with the <br /> Order to date. We appreciate the open communication including the notification of the <br /> financial constraints. In an effort to protect public health and complete the third task of <br /> the Plan DTSC requests your permission to access the property normal business hours <br /> for the purpose of the removal of the remaining cylinders at the property. DTSC staff will <br /> oversee the removal and coordinate for the exchange of keys to the gates which are <br /> part of the site security. Other activities may include the taking of photographs, <br /> collection of samples, conducting of tests, monitoring, surveying, and questioning of or <br /> conferring with person(s) to obtain information bearing on the nature and extent of <br /> hazardous substances disposed at the facility. <br /> With this letter, DTSC requests voluntarily authorization to access the property to <br /> conduct the removal and would ask that such an access agreement remain in effect <br /> until DTSC is notified in writing that you withdraw authorization. If you wish to authorize <br /> DTSC access voluntarily, please complete, sign, and return the attached access <br /> agreement.
