Box 173400 <br /> Denver, Colorado 80217-3400 <br /> GROUND WATER INVESTIGATION, LEPRINO FOODS, TRACY, SAN JOAQUIN COUNTY <br /> On 21 April 1994 Polly Lowry of my staff met with Mr. Bruce Hilton of Kleinfelder to discuss the <br /> progress of the ground water investigation at the Leprino Foods facility in Tracy. Mr. Hilton <br /> informed me that the fourth quarter 1993 ground water monitoring was not conducted as required by <br /> Monitoring and Reporting Program (MRP) No. 93-811. Any further required quarterly monitoring <br /> which is missed will subject you to fines of up to $1,000 per day. <br /> Kleinfelder's 13 April 1994 Ground Water Assessment Report (GWAR) contains the fust sampling <br /> of monitoring wells MW-2, -3, and -4 which meets the requirements of the MRP for the first <br /> quarter 1994. The monitoring results for the second quarter 1994 are due in a separate monitoring <br /> report by 30 July 1994. The enclosed memo contains our comments on the GWAR. All future <br /> reports or work plans submitted by Kleinfelder must include a cover letter from Leprino stating it <br /> agrees with the findings, recommendations, and work proposed. <br /> In your 24 November 1993 letter, you stated samples would be taken from the oil/water (o/w) <br /> separator on 21 December 1993, a permit would be obtained from the City by 7 February 1994 and <br /> the interim ground water extraction and treatment system (GWETS) would begin operating by 14 <br /> February 1994. In our 2 February 1994 telephone conversation, you told me the GWETS would <br /> start as soon as you received the final water sample results from the o/w separator. After that, we <br /> heard nothing more from you or Kleinfelder until contacted by Polly Lowry on 18 April 1994. You <br /> did not return her call, but Kleinfelder did. Mr. Hilton informed us that he sampled the effluent <br /> from the o/w separator on 20 April 1994 and that the results would be available around 4 May <br /> 1994. We still have not received those results. These delays in beginning remediation are <br /> unacceptable. The GWETS should have started operating more than a year ago. <br />
