and other material documents described as Exhibits in the.Plan and contemplated to be filed by <br /> the Exlibit Filing Date, but may file a summary thereof if such documentation is not available on <br /> or before February 25, 2008; provided, however, in the later event, the Debtors shall deliver <br /> drafts of such documents to counsel to the Creditors' Committee no later than five (5) days prior <br /> to the t:onfirmation Hearing, and with respect to any such drafts delivered after the Exhibit <br /> Filing]date, the Creditors' Committee shall have the right to raise objection to the form of such <br /> docum,nts at the Confirmation Hearing without the need to file a written objection to the <br /> Confirmation Hearing. <br /> D. Transmittal of Solicitation Packages to Certain Claim and Interestholders <br /> 22. The distribution of Solicitation Packages shall be subject to the following <br /> procedures as described below: <br /> 23. Unimpaired Claims. Pursuant to sections 1124 and 1126(f) of the <br /> Bankruptcy Code, Classes 1, 2, 3, 4, 5, 6, 7 and 8 are deemed Unimpaired Creditors and, <br /> therefore, are conclusively presumed to accept the Plan; hence, solicitation of votes with respect <br /> to such classes of claims is not required. Therefore, such classes of claims shall receive a <br /> Solicitation Package that includes the Confirmation Hearing Notice as well as the Unimpaired <br /> Creditor Notice, substantially in the form attached hereto as Exhibit D. In accordance with Rule <br /> 3017(d), the Unimpaired Creditor Notice shall give (a)notice of the filing of the Disclosure <br /> Statement and the Plan; (b) notice of the Court's approval of the.Disclosure Statement; (c) <br /> information regarding the Confirmation Hearing; (d) detailed,instructions for filing objections to <br /> confirmation of the Plan by the Confirmation Objection Deadline and (e)information about how <br /> any suca Claimant may receive a copy of the Plan and Disclosure Statement. <br /> 12 <br />
