Stantec <br /> PHASE 11 ENVIRONMENTAL SITE ASSESSMENT REPORT <br /> 5.0 Limitations and Certifications <br /> This report was prepared in accordance with the scope of work outlined in Stantec's contract <br /> and with generally accepted professional engineering and environmental consulting practices <br /> existing at the time this report was prepared and applicable to the location of the site. It was <br /> prepared for the exclusive use of Calpine Containers, Inc. and Union Bank of California for the <br /> express purpose stated above. Any re-use of this report for a different purpose or by others not <br /> identified above shall be at the user's sole risk without liability to Stantec. To the extent that this <br /> report is based on information provided to Stantec by third parties, Stantec may have made <br /> efforts to verify this third party information, but Stantec cannot guarantee the completeness or <br /> accuracy of this information. The opinions expressed and data collected are based on the <br /> conditions of the site existing at the time of the field investigation. No other warranties, <br /> expressed or implied are made by Stantec. The work was performed and is subject to the <br /> following inherent limitations: <br /> 1. Stantec derived the data in this report primarily from visual observations, a review of the <br /> laboratory certified analytical reports, and interviews with individuals having information <br /> about the Property. The passage of time, manifestation of latent conditions, or <br /> occurrence of future events may require further study at the Property, analysis of the <br /> data, and reevaluation of the findings, observations, and conclusions in the report. <br /> 2. The data reported and the findings, observations, and conclusions expressed in the <br /> report are limited by the scope of work outlined in Stantec's work plan dated February <br /> 18, 2011, and were agreed to by the client. <br /> 3. Because of the limitations stated above, the findings, observations, and conclusions <br /> expressed by Stantec in this report are not, nor should be, considered an opinion <br /> concerning the compliance of any past or present owner or operator of the site with any <br /> federal, state, or local law or regulation. <br /> 4.
