The <br /> RWD briefly describes the collection of process wastewater and storm water at the Ameron facility, the <br /> discharge of the wastewater to a pond on the Ameron site, and overflow of excess wastewater during <br /> storm events to the neighboring Teichert owned pond. <br /> Ameron does not have Waste Discharge Requirements (WDRs) for the wastewater ponds. Teichert <br /> Aggregates' facility does have WDRs for their wastewater ponds; however, the Teichert WDRs prohibit <br /> deposition of wastewater from sources other than the sand and gravel operation. The discharge of <br /> Ameron wastewater to the Teichert facility is a violation of the Teichert WDRs. <br /> The Ameron discharge is a waste discharge to land and is a violation of California Water Code (CWC) <br /> Section 13264. CWC Section 13264 describes prerequisites to wastewater discharge and CWC Section <br /> 13265 provides for civil penalties for discharging waste in violation of CWC Section 13264. The <br /> continuing discharge of wastewater may incur civil liabilities for both Ameron and Teichert Aggregates. <br /> Ameron must cease the discharge of wastewater to the neighboring Teichert owned pond. <br /> The application received by the Regional Board for the discharge of waste to surface water is denied and <br /> is inappropriate for the circumstance. By 17 June 2002, Ameron must submit a complete RWD for the <br /> existing wastewater discharge to land. This application must include a full characterization of the <br /> wastewater and a demonstration that the underlying groundwater is not impacted by this discharge. <br /> Please refer to the attached "Additional Questions" sheet that identifies items that shall be addressed in <br /> the RWD. The RWD shall present additional information that is needed to adequately describe all <br /> operations at the facility. <br /> An RWD consists of Form 200 Application/Report of Waste Discharge General Information (enclosed), <br /> a filing fee, and the answers to the Additional Questions. The RWD shall include a technical report <br /> California Environmental Protection Agency <br /> ped Recycled Paper <br /> The energy challenge facing California is real.
