Fax #: 468-3433 RE: Sinclair Trucking, 3780 Linne Road, Tracy, CA Site code: 1916 MESSAGE: We are in receipt of the letter sent to Ms Sinclair dated December 27, 2000. On behalf of Ms Sinclair, we are requesting an extension for an unknown amount of time, at least 45 days, to perform the work that was approved June 28, 2000 by the PHS/EHD. The following reasons necessitate the extension request: 1. Mr. Sinclair passed away prior to when the July 26, 2000 CPA, (cost pre-approval) was sent to him for signature. Currently, Mr_ Sinclair is the only one authorized to sign the CPA's and due to the circumstances, the pre-approval package was not signed and mailed to the Fund in Sacramento. Therefore, we do not have approval from the Fund for the work that was approved in the Workplan you referenced in your December 27, 2000 correspondence. 2. Ms Sinclair is in the process of working with the Probate Court to release the business funds and establish herself and her brother as the executors of the estate. This will give them the authority to manage the property, sign all necessary documents and pay past due invoices to both GTI and Del Tech. Based on the last update froth. Ms Sinclair, this process will take at least another 30 days. 3. Once the executor of the estate issue is resolved; we then need to assist Ms Sinclair with completion of the documents that the Fund requires to change ownership of the above mentioned clean up site. We anticipate this process to take approximately 30 days_ As you can see, the project is caught up in legal matters that cannot be avoided or rushed. We will proceed with our work as soon as Ms Sinclair notifies us that the legal issues are resolved_ We appreciate your patience and will keep you posted as things progress. Please Note.
