The General Order includes conditions that
address water quality protection measures at composting operations. A Fact Sheet on the
General Order is attached to this letter, and the General Order, and other related documents,
are available online at: http://www.swrcb.ca.-gov/water issues/programs/compost/.
This General Order applies to both existing and new composting operations. Existing
composting sites are those which conducted composting operations prior to 4 August 2015, and
new composting operations are those which commenced after 4 August 2015. All existing
composting operations without current individual WDRs or waivers are required to apply for
coverage or submit a Notice of Non-Applicability prior to 4 August 2016. All new composting
operations are required to seek coverage not less than 90 days prior to commencement of the
composting operation.
Composting operations currently covered by individual WDRs, existing conditional waivers, or
other general orders, may continue operations under the authority of those orders until those
orders expire or are subject to renewal. At that time, or earlier at the discretion of the Regional
Water Board, those existing composting operations may be required to enroll under the General
Order.
Composting operations may apply for coverage under the General Order by submitting the
following:
• A complete Notice of Intent (NOI) (Attachment C of the General Order).
• An appropriate filing fee (Cal. Code Regs., title 23, § 2200) which is also the first year
annual fee. The filing fee information is available at:
www.waterboards.ca._qov/resources/fees/water quality/docs/fv1516 wdr fees.pdf .
Please direct your filing fee questions to the staff listed at the end of this letter.
• A technical report including the information described in Attachment D of the General
Order. For existing composting operations, the technical report shall include a proposed
timeline for full compliance with the terms of the General Order, and must be as short as
practicable but may not exceed six years. For new composting operations, full
compliance must be met at commencement of composting operations.
KARL E. LONOLEY SOD, P.E., Coln I PAMELA C.
