Manifest number 013082557JJK (8/5/14) was not found on site. Manifest number 013079155JJK (5/8/14) was found without a signed off copy form the destination facility. No manifests were found on site for disposal of metal fines. According to the facility response to the 2012 inspection, metal fines are being handled as hazardous waste. Hazardous waste generators shall retain copies of all manifests for three years or until a copy signed off by the destination facility is received. The signed off copy shall be retained and made readily available for review for three years. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. This is a repeat violation, Class II. 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. Bead blast waste was observed uncontainerized on the floor of the shop. According to Mr. DuCharme, this waste was left when the bead blast machine was moved on Friday (5/1/15) afternoon. All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately place this waste into properly closed containers and ensure all hazardous waste containers are closed when not adding or removing waste. This is a repeat violation, Class II. 501 CCR 66265.192(a) Failed to comply with new hazardous waste tank system assessment requirements. Facility does not have a current tank assessment for the 1,000 gallon used oil tank. The tank assessment on site was dated February 26, 2010, which is past the five year date. The owner or operator of a hazardous waste tank shall obtain a written assessment reviewed and certified by an independent, qualified, professional engineer, registered in California attesting that the system has sufficient structural integrity, is acceptable for the transferring, storing, and treating of hazardous waste, and that the tanks and containment system are suitably designed. Immediately have an assessment prepared for the used oil tank. Submit a schedule showing when this will be accomplished to the EHD. This is a repeat violation, Class II.
