Manifest number 013079155JJK (5/8/14) was found <br />without a signed off copy form the destination facility. No manifests were found on site for disposal of metal fines. <br />According to the facility response to the 2012 inspection, metal fines are being handled as hazardous waste. <br />Hazardous waste generators shall retain copies of all manifests for three years or until a copy signed off by the <br />destination facility is received. The signed off copy shall be retained and made readily available for review for three <br />years. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of <br />the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the <br />initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to <br />determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within <br />45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception <br />Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the <br />efforts to locate the hazardous waste and the results of those efforts. Box 806 <br />Sacramento, CA 95812-0806 <br />Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to <br />the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. <br />This is a repeat violation, Class II. <br />403 <br />CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. <br />Bead blast waste was observed uncontainerized on the floor of the shop. According to Mr. DuCharme, this waste was <br />left when the bead blast machine was moved on Friday (5/1/15) afternoon. All hazardous waste containers shall be <br />closed at all times except when adding or removing waste. Immediately place this waste into properly closed <br />containers and ensure all hazardous waste containers are closed when not adding or removing waste. <br />This is a repeat violation, Class II. <br />501 <br />CCR 66265.192(a) Failed to comply with new hazardous waste tank system assessment requirements. <br />Facility does not have a current tank assessment for the 1,000 gallon used oil tank. The tank assessment on site <br />was dated February 26, 2010, which is past the five year date. The owner or operator of a hazardous waste tank shall <br />obtain a written assessment reviewed and certified by an independent, qualified, professional engineer, registered in <br />California attesting that the system has sufficient structural integrity, is acceptable for the transferring, storing, and <br />treating of hazardous waste, and that the tanks and containment system are suitably designed. Immediately have an <br />assessment prepared for the used oil tank.
