Main Street Investors PTP page 3 <br /> 601 E. Main Street, Stockton <br /> The MS Investors representatives stated there were no funds to pay for further <br /> investigation of the contamination. MS Investors purchased the property in 1989 <br /> and were not aware of the existing UST. The MS Investors representatives did <br /> not feel they should be held responsible since they did not own or operate the <br /> UST, do not own the property where the UST was located, and did not puncture <br /> the UST or cause a release. The EHD informed them that they admitted <br /> ownership by removing the UST. The EHD explained that according to the law <br /> the only parties that the EHD could name as responsible were the owner of the <br /> UST, the last operator of the UST, the property owner at the time the release was <br /> discovered, and every property owner since the release was discovered. <br /> The EHD explained that any responsibility for puncturing the UST would have to <br /> be pursued civilly. The EHD also explained that since they had removed three to <br /> four feet of soil prior to collecting soil samples beneath the UST that the <br /> contamination found was most likely from the UST leaking. The EHD <br /> recommended they apply to the California State Water Resources Control Board <br /> Cleanup Fund (Cleanup Fund) for reimbursement of corrective action costs. <br /> The MS Investors representatives stated that there may be some funds they <br /> could apply for that were the result of passage of Proposition 1 C and that they <br /> would have Mr. Pat Sabelhaus send this information to the EHD by electronic <br /> mail. The EHD received this information on November 9, 2007 from Mr. <br /> Sabelhaus. The application forms for the funds should be finalized within the <br /> next couple of months and the funds may be available by March or April of 2008, <br /> according to Mr. Sabelhaus. <br /> The EHD informed the MS Investors representatives that they would provide <br /> copies of public information in the EHD files and a copy of the Cleanup Fund <br /> application. These documents were obtained by a MS Investors representative <br /> on November 9, 2007. <br /> Since the meeting EHD has decided to send a "Notice of Responsibility" to the <br /> City of Stockton since they own the sidewalk and are the current property owner. <br /> The MS Investors will be mailed a copy of this notification. The City of Stockton <br /> and the MS Investors will have to determine who will be the active responsible <br /> party for the investigation. <br /> The EHD requires that by April 1, 2008, the MS Investors inform them of the <br /> date (reasonable time frame) when the work plan for further investigation <br /> will be submitted to the EHD. <br />
