The soil samples that were collected from beneath the former underground <br /> storage tanks that were removed on September 8, 1987 evidenced significant petroleum <br /> hydrocarbon contamination which must be investigated. <br /> You were informed of the site's status in correspondence dated March 4, 1994, December 3, <br /> 1996, and in correspondence May 1, 1997, PHS/EHD requested that a work plan be submitted <br /> by June 23, 1997 to perform the necessary investigation. You have not submitted the required <br /> work plan nor have you made any attempt to request an extension. In fact, when PHS/EHD has <br /> contacted you regarding the site, you have been hostile, unwilling to discuss the site and have <br /> maintained that you will not have anything to do with PHS/EHD. <br /> PHS/EHD scheduled an office meeting on August 25, 1997 to discuss with you any questions <br /> you may have about the regulatory requirements to investigate the site's contamination and to <br /> explain the request by the State Water Resources Control Board to final information before a <br /> Cleanup Fund Letter of Commitment could be issued. You did not attend the meeting. A <br /> PHS/EHD supervisor attempted to find out why you did not attend, however, after the supervisor <br /> asked to speak with you, the person answering the phone made negative statements about <br /> PHS/EHD and stated that they would hire an attorney if we did not stop harassing them. <br /> The facts clearly indicate that you are currently not in compliance with the Health and <br /> Safety Code. You must submit by September 12, 1997, the required work plan to <br /> investi ate the unauthorized release of petroleum hydrocarbons associated with the <br /> operation of the former tanks. If you fail to submit the required work plan, a referral will <br /> ti <br /> be made to the San Joaquin County District Attorney's Office for consideration of further <br /> enforcement actions. <br /> A Division of San Joaquin County Health Care Services <br />
