Box 2009 • (1601 East Hazelton Avenue) •Stockton, California 95201 <br /> c4�iFOR`'�� <br /> (209)468-3400 <br /> f � 1 <br /> J � <br /> JOHN AND MARGARET MARCI <br /> MARCIS DIESEL SERVICE <br /> 2973 LOOMIS ROAD DEC: 16 199 <br /> STOCKTON CA 95205 <br /> RE: 2969 Loomis Road SITE CODE: 2015 <br /> Stockton, Ca <br /> This letter is being sent in order to clarify the role of San <br /> Joaquin County Public Health Services, Environmental Health <br /> Division (PHS/EHD) in the listing of responsible parties for <br /> leaking underground storage tank sites currently in the Local <br /> Oversight Program (LOP) . <br /> PHS/EHD, through a contract with the California Environmental <br /> Protection Agency-State Water Resources Control Board (SWRCB) , <br /> has the responsibility to research, identify and list all <br /> possible responsible parties for each site in the LOP program. <br /> The responsible parties that can be named for a LOP site are <br /> determined using a definition of a responsible party that is <br /> included in our contract with the SWRCB. PHS/EHD can only name <br /> those responsible parties identified using the definition in our <br /> contract. <br /> PHS/EHD's responsibility is limited only to the naming of <br /> identifiable responsible parties. PHS/EHD does not in any way <br /> become involved in negotiations between listed responsible <br /> parties in establishing respective responsibilities for the costs <br /> associated with the site cleanup, nor will PHS/EHD attend any <br /> meeting convened for this purpose. <br /> In addition, PHS/EHD files are not made available during meetings <br /> held at this office to discuss site cleanups. Although our files <br /> are public record, there is a process by which these files are <br /> made available for review. Any person or persons wishing to <br /> review files must complete a Public Records Release Application. <br /> In addition, there is a fee associated with public review of <br /> files; however, this fee is waived for the owners of the property <br /> and the listed additional responsible parties. <br /> A Division of San Joaquin County Health tare Setvsces �� <br />
