Olive Avenue <br /> Fresno, CA 93778 <br /> RESPONSE LETTER TO-CALTRANS FOR- R-UST-C-ASES, <br /> SAN JOAQUIN COUNTY(REGIONAL BOARD CASE# 390702 AND #391147) <br /> On 11 October 2010, Regional Board (RB) staff received a request from you for a letter <br /> concerning liabilities for future cleanup by California Department of Transportation (Caltrans) <br /> at the following underground storage tanks (USTs) closed cases: the Center Plumbing <br /> (RB #390702) at 2001 North Main Street in Manteca, and the 7/Eleven #32262 (RB 391147) <br /> at 2360 Grant Line Road in Tracy. It is our understanding that CalTrans intends to purchase <br /> these properties. Both USTs cases were managed under the direction of the San Joaquin <br /> County Environmental Health Department (SJCEHD) as lead regulatory agency, and were <br /> closed by the SJCEHD as low risk sites in 1999 and 2010, respectively. There is currently no <br /> information in our files on these closed cases that suggests additional work is necessary. <br /> Hence we are not currently, nor do we anticipate requesting the Responsible Parties (RPs), <br /> including CalTrans upon ownership of said properties, conduct any environmental work at <br /> these sites. <br /> If additional information comes to light showing that a new release occurred or that the <br /> previous releases were more extensive than reported, we may request the RPs conduct <br /> additional environmental work. If CalTrans' only involvement is as property owner, we would <br /> likely hold you secondarily liable and only require you provide reasonable access to any <br /> identified responsible party(ies). if such reasonable access is denied or if there are no other- <br /> financially <br /> therfinancially viable RPs, then Caltrans may be named as a responsible party under California <br /> Code of Regulations, Title 23, Article 11 Corrective Action Requirements § 2720 and held <br /> liable for the future work.
