Rationale why conditions remaining at the site will not adversely == <br /> impact water- duality; health, or other bene.tica? uses. <br /> Additional information submitted, such as risk assessments or fate and transport <br /> modeling, must include the assumptions used. <br /> Where it has been decided that only soil has been impacted, evidence substantiating <br /> the condition must be submitted. <br /> Concurrence with the site conditions will include the following: <br /> "Based on the information provided, Board staff has determined [and <br /> the Local Implementing Agency concurs,]that appropriate response <br /> actions have been completed, that acceptable remedial practices were <br /> implemented, and that, at this time, no further investigation, remedial <br /> or removal action, or monitoring is required at [Facility name and <br /> address]. <br /> Nothing in this.determination shall constitute or be construed as a <br /> satisfaction or release from liability for any conditions or claims arising <br /> as a result of past, current, or future operations at this location. <br /> Nothing in this determination is intended or shall be construed to <br /> limit -:he rights of any parties with respect to claims arising out of or <br /> relating to deposit or disposal at any other location of substances <br /> removed from the site., Nothing in this determination is intended or <br /> shall be construed to limit or preclude the Board or any other agency <br /> from taking any further enforcement actions. <br /> This letter does not relieve the tank owner of any responsibilities <br /> mandated under the California Health and Safety Code and California <br /> Water Code if existing, additional, or previously unidentified <br /> contamination at the site causes or threatens to cause pollution or <br /> nuisance or is found to pose a threat to public health or water quality. <br /> Changes in the present land use may require further assessment and <br /> mitigation." <br />
