0 <br /> ATC Associates Inc. <br /> M%TC 1117 Lone Palm Avenue, Suite 201 <br /> Modesto,California 95351 <br /> 209-579-2221 <br /> fax: 209-579-2225 <br /> SITE ACCESS AGREEMENT <br /> This Agreement is entered into as of the twenty-fourth day of February 2010, between <br /> ATC Associates Inc ('Investigator") and Mr. Jawaid Aiktar, (the 'Property Owner"). <br /> RECITALS <br /> The Property Owner owns certain real property located at 4126 E. Main Street, Stockton, <br /> A. California (The "Property"). <br /> B. Investigator is conducting a subsurface investigation pursuant to the <br /> terms of an agreement entered into with Mr. Jawaid Aiktar. <br /> C. Investigator wishes to conduct environmental sampling and testing on the <br /> Property to assist in this investigation as directed by the San Joaquin <br /> County Environmental Health Department. <br /> NOW THEREFORE, in consideration of the mutual covenants contained herein, it is <br /> hereby agreed as follows: <br /> 1. Grant of License. Subject to the terms and conditions of this Agreement, <br /> the Property Owner hereby grants Investigator a license to enter the <br /> Property for the limited purpose of observing the site and collecting <br /> environmental samples. Investigator may be accompanied in these <br /> activities by authorized representative of San Joaquin County <br /> Environmental Health Department. <br /> 2. Limitations on Use. <br /> a.) Prior to each entry onto the Property, Investigator shall provide forty-eight <br /> (48) hours notice to the Property Owner, arrange for access, and, if <br /> requested by the Property Owner, allow oversight of all on-site activities. <br /> b.) Investigator shall ensure that none of its activities on the Property <br /> unreasonably interferes with or delays any other activities which are being <br /> undertaken on the Property. <br /> 3. Term. The term of this Agreement shall commence on the date of <br /> execution of this Agreement and shall continue thereafter until <br /> Investigator has completed its investigation of possible groundwater <br /> contamination or until December 31, 2010, whichever is sooner; provided, <br /> however, that with the mutual consent of both parties this term may be <br /> extended as necessary to accommodate further investigation. <br /> 4. Agreement Not Admission. By entering into this Agreement, neither the <br /> Property Owner or Investigator is admitting any responsibility for any <br /> contamination at the Property.
