Box886 <br /> ES <br /> Benecia, CA 94510 <br /> LACK OF SUBSTANTIAL PROGRESS IN DEFINING AND REMEDIATING SOIL AND <br /> GROUND WATER CONTAMINATION <br /> The Central Valley Regional Board Underground Tank Computer Data <br /> Base indicates that soil and ground water contamination were <br /> identified at the Food and Liquor Store at 890 North Main Street, <br /> Manteca on, or prior to, 5 March 1987. Our records also <br /> indicate that the only site activity since March of 1987 was an <br /> authorization for Kleinfelder to resample and analyze ground <br /> water at the site, dated 13 May 1988. To date, commitments made <br /> by The Customer Company to define the extent of contamination and <br /> remediate the site, have not been fulfilled. A Problem <br /> Assessment Report, completely defining the vertical and <br /> horizontal extent of soil and ground water contamination, and <br /> proposing remediation to cleanup that contamination, is due in <br /> this office 8 August 1988. Failure to comply with this request <br /> may subject The Customer Company to formal enforcement action. <br /> Section 13267 of the California Water Code states, in part, that: <br /> " (a) A regional board, in establishing or reviewing any <br /> water quality control plan or waste discharge <br /> requirements, or in connection with any action relating <br /> to any plan or requirement or authorized by this <br /> division, may investigate the quality of any waters of <br /> the state within its region. <br /> (b) In conducting an investigation specified in <br /> subdivision (a) , the regional board may require that <br /> any person discharging or proposing to discharge waste <br /> within its region or any citizen or domiciliary, or <br /> political agency or entity of this state discharging or <br /> proposing to discharge waste outside of its region that <br /> could affect the quality of waters within its region <br /> shall furnish, under penalty of perjury, those <br />
