Ingraham i T <br /> Office of the City Manager HEN H <br /> IN"V;If?ONVIE"N" L <br /> City of Stockton <br /> Stockton, CA 95202-1997 <br /> Dear Mr. Ingraham: <br /> UN GROUND STORAGE TANK (UST) LOCAL OVERSIGHT PROGRAM, SITE NOS. 1013, 1102, <br /> 1117 , 1203, AND 1253, SAN JOAQUIN COUNTY <br /> We ave received your letter dated August 9, 1991 which enclosed a check <br /> totalling $3,597.65 for UST oversight services by Public Health Services of <br /> San Joaquin County. Your letter requests that we accept the $3,597.65 as <br /> payment in full for the costs billed totalling $12,936.31. We are returning <br /> the checkas we are required by law to recover all costs incurred for the <br /> services performed through June 30, 1990. The City of Stockton will also be <br /> billed in the future for oversight services from July 1, 1990 through <br /> December 31, 1990. <br /> Assembly Bill (AB) 3560, which was recently enacted by the Legislature, states <br /> that the responsible party will be liable for not more than 150 percent of <br /> site specific costs actually incurred by the local agency. This method of <br /> allocating costs became effective for costs incurred on or after January 1, <br /> 1991. The costs in question were incurred prior to January 1, 1991 and <br /> therefore are not subject to the provision of AB 3560. The provisions of <br /> AB 3560 are not retroactive. The purpose of San Joaquin County sending you <br /> the new Notices of Reimbursement was to inform you of this change. We have <br /> enclosed copies of the original Notices of Reimbursement for the above sites <br /> which explain the authority for cost recovery of the $12,936.31 billed for San <br /> Joaquin County and Regional Water Quality Control Board services through <br /> June 30, 1990. <br /> On August 22, 1991 the City of Stockton was also invoiced for State Water <br /> Resources Control Board (State Board) Program Management costs totalling <br /> $816.45 for the above sites. We have enclosed copies of the August 22, 1991 <br /> invoices for your information. Each invoice includes a description of the <br /> State Board activities. <br /> Your letter requested more information on the type of costs contained in the <br /> invoices. As stated in our September 19, 1990 letter, the local agency <br /> invoices contain several categories of costs. Site specific charges represent <br /> those charges for work done that is directly related to your sites. Examples <br /> of such activities include: sampling for soil or groundwater contamination, <br /> conducting site inspections, reviewing reports and workplans, or preparing <br /> correspondence.
