Miner Street <br /> Stockton, CA <br /> I have reviewed your letter dated February 27, 2009, to St. John's Episcopal Church of Stockton <br /> regarding the compliance review of our files for the above subject site. I have also reviewed the <br /> March 25, 2009, letter from Mike Griffin of St. John's Episcopal Church to Ronald Duff of the <br /> State Water Resources Control Board Cleanup Fund (CUF). <br /> I apologize for our agency having conflicting information in our underground storage tank file for <br /> 135 E. Miner Street, Stockton. In his letter Mr. Griffin explains that several underground storage <br /> tanks (LISTS) have been found in or near the sidewalks of the Cancun Restaurant that operates <br /> on the property owned by St. John's Episcopal Church. This property and building used to be <br /> occupied by a car dealership so it is not surprising that unknown LISTS are found during <br /> construction activities in the sidewalk. <br /> The San Joaquin County Environmental Health Department (EHD) received a complaint about <br /> two LISTS discovered in the sidewalk at Hunter and Miner on March 12, 2001. A file was started <br /> and initially labeled 135 E. Miner because that is the address of the Cancun Restaurant. Those <br /> UST's were 76 feet north of the north wall of the restaurant and 160 feet north of the south wall <br /> of the restaurant. A drawing of the UST's location is attached. The file address for those two <br /> LISTS was changed to Hunter Street. Two narrative sheets and a letter regarding those two <br /> USTs were placed in 135 E. Miner Street file. When the CUF staff reviewed the 135 E. Miner <br /> Street file this caused them to think the LISTS were discovered in 2001 and not removed until <br /> 2008 which is not the case. There was no contamination found beneath the two UST's that <br /> were closed in place in 2001 so corrective action was not required. <br /> On October 18, 2007, the EHD received a complaint about one UST found in the sidewalk at the <br /> corner of Hunter and Miner (135 E. Miner Street), near the south wall of the restaurant. This <br /> UST was removed on January 17, 2008, and soil contamination was discovered. An <br /> unauthorized release form was filed, the site was placed in the Local Oversight Program, and <br /> St. John's Episcopal Church was directed to continue investigating the extent of the <br /> contamination which they have done. <br />
