Box 944212 <br /> Sacramento, California 94244-2120 <br /> Re: Claim No. 19192, Site Address of 135 East Miner Ave, Stockton, California <br /> This writing is in response to Lisa Labrado's letter dated February 27, 2009 notifying St. Johns <br /> Episcopal Church that during a detailed review of the church's application for inclusion in the State <br /> Cleanup Fund, you had determined that our claim for the referenced site is ineligible for <br /> reimbursement in the Cleanup Fund and that our request for inclusion into the fund was denied. <br /> The stated reason for ineligibility was due to our not permitting or removing the tank within a year of <br /> when we should have been aware of the tank and the UST permitting requirements. Both your <br /> findings together with this statement are incorrect. It appears that you are not fully informed of the <br /> situation regarding the property and the tanks. <br /> The property in question was acquired by the church in 1995 from a premier auto dealer. Neither the <br /> car dealer nor the church personnel were made aware or had any knowledge of there being any <br /> underground tank of any kind or nature on, in or under the property. Subsequent to the church's <br /> acquisition, entities other than the church have found and exposed four separate abandoned <br /> underground storage tanks at the property address of 135 East Miner Avenue. <br /> The findings of the four tanks are discussed in the following descriptions. <br /> • Tank#1 and#2 were discovered at the time the Cancun Restaurant, now located at the <br /> above address, was in the process of relocating from a site the City had purchased across <br /> Miner Avenue. Your letter refers to a County compliant inspection on March 12, 2001 that <br /> revealed two visible fill tubes in the sidewalk on Hunter Street. The two stand pipes or fill <br /> pipes were connected to Tanks#1 and #2. Their specific location is within the boundary of <br /> the city sidewalk, approximately 160 feet North of the South boundary line of the subject <br /> property referred to herein as 135 East Miner Ave. <br /> • You referenced an abatement memo sent to the City, Cancun Restaurant and St. John's <br /> Church.
