It is Unocal's opinion <br /> that once the installation of the proposed well is completed the site will meet the criteria established <br /> for a low risk groundwater case. After receiving your response to this letter I will be glad to <br /> schedule a meeting with you if you feel it is appropriate. <br /> Attached for your review is a copy of the definitions of a low risk soils case and a low risk <br /> groundwater case. Also attached is a"Fact Sheet Questions and Answers"which clarifies some of <br /> the key issues. As I previously stated, it is Unocal's opinion that this site fits the definition of a <br /> low risk groundwater case. <br /> Prior to any proposed meeting it would be most helpful to have your agency's written opinion as to <br /> why this site should not be considered a low risk groundwater case. Specifically,I would like to <br /> know if your agency believes the groundwater plume is stable or migrating.Your statement that the <br /> proposed additional well will provide a down gradient non-detect monitoring point seems to <br /> indicate you concur that the plume is not migrating. I would also like to know if your agency <br /> considers this site to present a significant risk to human heakiit. <br /> I anticipate our primary difference of opinion will be in the area of source removal. I do not think <br /> we will be able to come to an agreement on this issue since it seems to be more philosophical than <br /> technical. This issue will most likely have to be resolved through a ruling by the State Board. <br /> Please send me your response so a meeting can be arranged.
