It is Unocal's opinion
that once the installation of the proposed well is completed the site will meet the criteria established
for a low risk groundwater case. After receiving your response to this letter I will be glad to
schedule a meeting with you if you feel it is appropriate.
Attached for your review is a copy of the definitions of a low risk soils case and a low risk
groundwater case. Also attached is a"Fact Sheet Questions and Answers"which clarifies some of
the key issues. As I previously stated, it is Unocal's opinion that this site fits the definition of a
low risk groundwater case.
Prior to any proposed meeting it would be most helpful to have your agency's written opinion as to
why this site should not be considered a low risk groundwater case. Specifically,I would like to
know if your agency believes the groundwater plume is stable or migrating.Your statement that the
proposed additional well will provide a down gradient non-detect monitoring point seems to
indicate you concur that the plume is not migrating. I would also like to know if your agency
considers this site to present a significant risk to human heakiit.
I anticipate our primary difference of opinion will be in the area of source removal. I do not think
we will be able to come to an agreement on this issue since it seems to be more philosophical than
technical. This issue will most likely have to be resolved through a ruling by the State Board.
Please send me your response so a meeting can be arranged. If you have any questions or
concerns, please call me at(510) 277-2334.
Sinc ely / L
Obert A. Boust
cc: Greg Gurss
