For the reasons stated below, Unocal cannot <br /> agree to these terms. <br /> Your demand for $50,000 seems to be based on the premise that any money Unocal pays <br /> you would be reimbursed by the State UST Cleanup Fund. To the best of my knowledge, <br /> the Fund would not pay for that type of expenditure. <br /> Access to perform the environmental work will not have any significant effect on your <br /> use of the property. The installation of the wells will most likely take two days. After <br /> that the wells will have to be sampled every three months. This normallv takes no more <br /> that a few hours. The disruption to your use of the property will be minimal. Moreover, <br /> property owners throughout California have granted Unocal similar access to their <br /> property on the terms contained in the enclosed access agreement. Therefore, Unocal's <br /> proposal is commercially reasonable and consistent with customary practice. <br /> It is important for this environmental work to be completed. Without access, Unocal will <br /> not be able to complete the required environmental work. In that case, the required work <br /> may become the responsibility of the property owner. <br /> I have again attached two signed copies of the original access agreement without any <br /> changes other than the date. Your signature will allow Unocal to complete the <br /> environmental work required by the San Joaquin County Public Health Services. Your <br /> prompt attention to this matter would be greatly appreciated. <br />
