437 E. Miner Street, Stockton
Page 3
UNOCAL was informed in PHS/EHD letters dated January 30, 1997, March 18, 1997,
June 3, 1997, and June 25, 1997 that they were out of compliance with PHS/EHD
directives which are based on California laws, regulations and adopted policies. On July
10, 1997, UNOCAL chose not to attend a PHS/EHD office hearing to discuss this site.
After UNOCAL failed to attend the July 10, 1997 office hearing, PHS/EHD referred this
site to the San Joaquin County District Attorney, Environmental Prosecutions Unit
(SJCDA Environmental Prosecutions Unit) for legal action. It should be noted by the
State Water Resources Control Board that numerous other UNOCAL sites also have
been referred to the SJCDA Environmental Prosecutions Unit for enforcement action. It
is our understanding that the SJCDA Environmental Prosecutions Unit and UNOCAL's
counsel are working toward a satisfactory resolution of all referred issues.
PHS/EHD has directed other responsible parties to perform, this type of investigation
and deeper soil and groundwater contamination has been documented. In order to
protect and restore water quality, thorough investigations of contamination and remedial
alternatives must be performed.
If you have any questions contact me at (209) 468-3449.
Donna Heran, REHS, Director
Environmental Health Division
Margaret Lagorio, Supervising REHS
Site Mitigation Unit
c: David Irey, San Joaquin County District Attorney, Environmental Prosecutions
Unit
Peter J.
