The following is an itemized list of hazardous materials violations that have not been addressed for LPS WATER CO/TOWER PARK MARINA as of May04, 2020. Open violations from February 25, 2020 inspection Violation#2 - Failed to complete and electronically submit a hazardous materials business plan. The facility's business plan was not submitted electronically to the California Environmental Reporting System (CERS)for 2019 and 2020. As of January 1, 2013, all businesses were required to submit all business plans electronically. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. ❑ This violation was corrected ❑ This violation will be corrected by (date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#3 - Failed to establish and implement a hazardous materials business plan. A Hazardous Materials Business Plan has not been established or implemented. A Hazardous Materials Business Plan shall be established and implemented for emergency response to a release or threatened release of a hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and pressure. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD. ❑ This violation was corrected ❑ This violation will be corrected by (date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#5 - Failed to complete and/or submit hazardous materials inventory for all reportable materials on site. Two above ground tanks of aluminum sulfate(=/> 500 gallons), four 55 gallon drums and a 500 gallon tank of sodium hypochlorite, Two caustic soda tanks, and a propane tank(=/> 250 gallons), and two 55 gallon drums of JC 1830 (acute aquatic toxicity)were found on site that have not been reported for 2019 and 2020. Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval. The Hazardous Materials Inventory forms for bleach, caustic soda, propane and aluminum sulfate are not accurate. The federal hazard categories have not been updated; the size of the largest container of aluminum sulfate is 500 gallons vs. 55 gallons; the size of the of bleach is 500 gallons vs. 55 gallons; the storage pressure and storage temperature elements for propane have not been completed. This information must be current and submitted as part of the business plan.
