I reference. I have worked with several dairies located in San Joaquin County assis ' g <br /> • 2 them with the design and construction of manure waste retention systems. I <br /> 3 familiar with the California state regulations dealing with confined animal feeding <br /> 4 operations and their federal counterparts. I am also familiar with the local county <br /> 5 requirements applicable to dairies. <br /> 6 3. I have been asked by the Kimbroughs to review and analyze the Dairy <br /> 7 waste control system. To this end, I have performed the following tasks: <br /> 8 A. I have reviewed the Tentative Decision of Judge Holly in State v. <br /> 9 Kimbrough, San Joaquin Superior Court Case No. 007544. <br /> 10 B. I have inspected the Dairy on several occasions in order to fully <br /> 11 understand how manure waste is currently handled there. This inspection has <br /> 12 included an examination of the corrals and the existing waste pond and <br /> 13 appurtenances attached thereto, including the pump systems which service the corrals <br /> 14 and milking barn. <br /> 15 C. I have toured the Dairy property to inspect the perimeter, <br /> 16 particularly on the south and west sides where I understand that surface drainage has <br /> 17 occurred historically from the Byron Bethany Canal which terminates at the <br /> 18 southwest corner of the Dairy property and from the ranch on the south. In addition, <br /> 19 I have examined the existing perimeter berms which are on the south and west sides <br /> 20 of the property. <br /> 21 D. I have reviewed improvement plans prepared by. Visi n <br /> 22 Enterprises dated October 19, 1998. <br /> 23 E. I have reviewed existing topographical maps for the area <br /> 24 surrounding the Dairy. My survey crew has also surveyed the perimeter of the Dairy- <br /> 25 <br /> a .25 In addition, I have been provided with data from J.R.
