MACHADO, <br /> AND BRUCE XrvIBROUGH JOANNE IQRvIBROUGH <br /> •LUCKY J DAIRY <br /> SAN JOAQUIN COUNTY <br /> Grant Line Road and Hansen Road, over a mile from where the discharge had commenced at the <br /> retention pond, An EC of 3100 µmhos/cm was noted for the wastewater discharging into the ditch <br /> adjacent to the dairy. Wastewater flowing in the roadside ditch at Hansen Road had an EC reading of', <br /> 3300 pmhos/cm. Flow being discharged along Grant Line Road was estimated at approximately 30 <br /> gallons per minute over a period of six days. The inspection also revealed corral runoff had <br /> discharged into the ditch along Patterson Pass Road. The Dairy is located at the intersection of Grant, <br /> Line Road and Patterson Pass Road. <br /> 7. On 3 February 1997, a Notice of Violation was issued to the Lucky J Dairy in response the inspection <br /> conducted in January 1997. <br /> 8. On 18 February 1998,Regional Board Staff conducted another inspection in response to a complaint <br /> that Lucky J Dairy was discharging wastewater off property. Wastewater was first observed in the: <br /> roadside ditch along Grant Line Road, more than a mile away from the Dairy. At the Dairy, the <br /> inspection revealed wastewater being discharged from the retention pond adjacent to Grant Line <br /> Road. There was no freeboard in the pond and there was evidence that the pond had overflowed. <br /> Seeps from rodents holes were also evident. There was also corral runoff flowing into the ditch along <br /> Patterson Pass Road. An EC reading of 3900 gmhos/cm was taken at the intersection of Grant Line <br /> and Patterson Pass Road where the two ditches converge. <br /> 9. A Notice of Violation was issued to Lucky J Dairy on 9 April 1998 in response discharge of waste t <br /> surface waters observed during the 18 February 1998 inspection of the Facility. <br /> 10.Drainage from the ditch along Grant Line Road discharges into an agricultural drain and subsequent) <br /> discharges to the San Joaquin River. <br /> 11. The beneficial uses of the Sacramento-San Joaquin Delta are domestic, municipal,industrial, and <br /> agricultural supply, contact recreation;warm-water fish habitat, warm and cold-water fish migration <br /> warm-water spawning,fish and wildlife habitat, and navigation. <br /> 12.Beneficial uses of groundwater in the area around the Facility are domestic,municipal, and <br /> agricultural supply. <br /> 13. Title 27,Division 2, Chapter 7, Subchapter 2, Article 1, Section 22562 (a) of the California Code o <br /> Regulations(CCR) states, in part: <br /> "Confined animal facilities shall be designed and constructed to retain all facility wastewater <br /> generated,together with all precipitation on, and drainage through, manured areas during a 25-ye <br /> ar <br /> . 24-hour storm." <br /> 14.
