The
purpose of the office meeting was to help clarify some questions that Mr. Montijo had regarding the Letter of
Violation (LOV) issued by the California Integrated Waste Management Board (CIWMB) for the waste tire site
located at 2498 E. Main St., Stockton,California.
For reference, the following violations of Division 30, PRC and Title 14, CCR were documented in the LOV issued
by the CIWMB:
30 PRC 42834 Operator Authorized by Permit .
14 CCR 17351 Fire Prevention Measures
14 CCR 17353 Vector Control Measures
14 CCR 17354 Storage of Waste Tires
14 CCR 18423 Filing of Application
According to Title 14 CCR 17354, the EHD explained to Mr. Montijo that in order to achieve compliance, he must
store less than 500 waste tires on site, and he must rack and stack his used tires appropriately so that they can be
individually inspected and as a result will not be counted as waste tires. Furthermore, if Mr. Montijo can maintain
less than 500 waste tires on site, the site will be excluded for the other violations referenced above.
The EHD will reinspect the waste tire site on January 20,2004 to verify if compliance has been achieved.
For questions of information regarding this matter, please contact Ted Tasiopoulos of my staff at(209)953-7698.
Sincerely,
Robert McClellon, Supervisor REHS -
Environmental Health Department
CC: Steve Posner,CIWMB,MS-15
