Main St.,Stockton,California <br /> Facility No.39-TI-0281 <br /> Dear Mr. Montijo: <br /> Background: On December 16, 2003, the Environmental Health Department(EHD)had an office meeting with <br /> owner, Mr. Montijo. The EHD explained to Mr. Montijo that in order to achieve compliance, he <br /> must store less than 500 waste tires on site,and he must rack and stack his used tires appropriately <br /> so that they can be individually inspected, and as a result will not be 'counted as waste tires. <br /> Furthermore, if Mr. Montijo can maintain less than 500 waste tires on site, the site will be <br /> excluded for the other violations referenced below. The following violations of Division 30, PRC <br /> and Title 14,CCR were documented in the LOV issued by the CIWMB: <br /> Violations: 30 PRC 42834 Operator Authorized by Permit <br /> 14 CCR 17351 Fire Prevention Measures <br /> 1,4 CCR 17353 Vector Control Measures <br /> 14 CCR 17354 Storage of Waste Tires <br /> 14 CCR 18423 Filing of Application <br /> Observations: On January 20,2004,The EHD conducted a re-inspection to verify if compliance was achieved at <br /> the facility. It was observed that the facility had racked and stacked all new and used tires <br /> according to 14 CCR 17354 for individual inspection. As a result,the new and used tires were not <br /> counted as waste tires. It was also observed that approximately 325 waste tires were on site at <br /> time of inspection.
