On March 23, 2005, a DEH inspector observed a Chevrolet pickup registered to <br /> 2 RODE MONTIJO containing approximately 30 waste tires, at the EL CAMINO TIRE store at <br /> 3 340 N. Wilson Way in Stockton. The truck did not have a CIWMB:waste fire hauler decal. <br /> 4 9. On April 18, 2005, the DEH inspector observed and photographed the same <br /> 5 Chevrolet pickup truck containing approximately 25 waste tires in the parking lot of EL <br /> 6 CAMINO TIRE, 48 E. Charter Way in Stockton. The truck did not have a CIWM8 waste tire <br /> 7 hauler decal. <br /> 8 10. On June 6, 2005, the DEH inspector observed EL CAMINO TIRE hauling more <br /> 9 than 10 waste tires vehicles at two of their stores; the EL CAMINO TIRE store located at 48 E. <br /> 10 Charter Way in Stockton: and the EL CAMINO TIRE located at 340 N. Wilson Way in Stockton. <br /> 11 Both vehicles hauling waste tires were registered to RODE MONTIJO, and did not have waste <br /> 12 tire hauler decals. <br /> 13 11. On December 2, 2005, the DEH inspector learned from MIKE MONTIJO, <br /> 14 manager of the Et_ CAMINO TIRE store located at 48 E. Charter Way in Stockton that EI <br /> 115 Camino Tire's practice is to haul approximately 20 waste tires at a time. MR. MONTIJO <br /> 16 admitted that he used a Chevy Pickup, CA license plate # 51197805 to haul waste tires from <br /> 17 and to this store. There was no waste tire hauler decal on the truck. MR. MONTIJO admitted <br /> 18 the store did not have waste tire manifests. <br /> 19 ALLEGATIONS OF SPECIFIC VIOLATIONS <br /> 20 12, RESPONDENT is in violation of PRC section 42951, which makes it unlawful to <br /> 21 engage in the transportation of waste tires unless holding a valid Waste Tire Hauler <br /> 22 Registration, unless exempted as specified in PRC Section 42954, <br /> 23 13. RESPONDENT is in violation of under PRC section section 42954, which <br /> 24 provides that a tire dealer or waste fire generator shall not give, contract, or arrange with <br /> 25 another person to transport used or waste tires unless that person is a registered waste tire <br /> 26 hauler or is exempt. <br /> 27 <br /> 28 <br /> i <br /> -3- <br />
