They have CTLs for waste tires leaving the site but no
CTLs for used tires coming to the site. They have 250 waste tires leaving each week and 250 used and waste
tires coming to the site each week according to the store manager. They have several thousand used tires
racked and stacked. 600 of the used tires don't meet the storage criteria and were included in the waste tire
count of 850. They also have a panel van parked at the site which is not registered to haul waste/used tires. We
are meeting with owner next week to discuss his hauling and storage issues. We plan to issue an Area of
Concern for PRC 42951 (Hauler Registration) and Violation for 14CCR18461 (Manifests for End Use Facilities).
How do proceed in regards to the previous Admin. Complaint 2005-10922-AC? Do we refer the case to CIWMB a
second time? Can we handle this on the local level as a DA referral?
Garrett Backus
San Joaquin County Environmental Health Dept
(209) 468-2986
-----Original Message-----
From: Cambridge, Keith [mailto:kcambrid@CIWMB.ca.gov]
Sent: Monday, March 13, 2006 5:07 PM
To: Garrett T. They did not
contest the administrative complaint; therefore they are now being required to pay the total fine of
$3,000.00. This will be going to the Board Chair for approval, but I don't foresee any problems with
this. Thanks for your help on this case and please let us know if they continue to cause problems,
the second time around, fines are much stiffer.
Let me know if you would like us to send a copy of the Administrative complaint for your records. It's
a PDF so I will have to fax it to you
5/12/2006
