Box 4025, Sacramento, CA 95812-4025 Terry Tamminen www.ciwmb.ca.go Arnold Schwarzenegger Secretary for Governor Environmental Protection / 6/9/2004 _ California Waste Tire Mgmt (1007073) 507 E 11th St Tracy, CA 95376-4021 JUNE 2004 ADVISORY LETTER RE:ERRORS/OMISSIONS NOTED ON MANIFEST AND/OR LOG FORMS Dear California Waste Tire Mgmt: The California Integrated Waste Management Board(CIWMB)is in receipt of Manifest(s)and/or Tire Trip Log(s) that were submitted by your company to the CIWMB,Waste Tire Hauler Registration&Manifest Program.A review of these documents,completed between the time periods of 2/1/2004 to 5/15/2004,indicates the errors or omissions noted on the back of this letter. These errors and omissions are violations of California law. Because the Waste Tire Hauler Registration&Manifest Program is still in its initial roll-out phase,we are not taking any enforcement action at this time;however,effective July 1,2004 any future violations may result in a notice of violation and/or enforcement action, as deemed appropriate. By giving you this notice,we hope to call attention to deficiencies that you should correct in future manifests and trip logs. Please make sure that these errors/omissions identified on the back of this letter will be corrected in the future by completely and accurately filling out the hauler portion of the Manifest(Part I.)and Tire Trip Log forms. Further,as a hauler,you must ensure that the Generator or End-Use Facility accurately completes Part II of the Manifest form. Transporting waste or used tires without a properly completed Manifest or Tire Trip Log form is a violation of Title 14,California Code of Regulation, §18460.2(h)as referenced below and is punishable by civil fines of up to$25,000 per violation[Public Resources Code, §42962(a)]. 18460.2.Waste Tire Manifest System Requirements for Registered Waste Tire Haulers. (h)The waste tire hauler shall not transport the used or waste tires without a properly completed Manifest Form and Tire Trip Log.
