The Unit III file is not available so this information is taken from the Unit IV file. During the <br /> 1980s the facility was out of compliance and office hearin ^were held with Doug Wilson present. This site was referred to <br /> the District Attorneys Office in the 1990s. February 22,1996, the dispensers were removed. <br /> Mr. Khaled Anber, the owner, said that he purchased the property in 2000. File entry confirms this information. <br /> Three USTs (one 6280-gallon unleaded tank, one 12000-gallon regular gasoline tank, and one 8427-gallon diesel tank) <br /> were removed from the site on March 2, 2002. Positive results for benzene, toluene, ethyl benzene, m,p,o-xylenes, and <br /> gasoline were found in many of the soil samples collected during the tank removals. <br /> Environmental Health Department (EHD) sent a letter to Khaled Anber on August 16, 2002, stating that further <br /> investigation was needed to determine the extent of contamination found during the UST removals. <br /> EHD notified Mr. Anber on October 18, 2002, and December 13, 2002, that a work plan was needed. Mr. Anber failed to <br /> comply. <br /> On March 4, 2003, Margaret Lagorio, Vicki McCartney, Elaine Antolin from the District Attorneys Office, and Mr. Anber met <br /> for an administrative meeting. Mr. Anber agreed to dates for submittal of: UST removal soil results report, work plan for <br /> further investigation, work performed, and report of the investigation. <br /> Three boring were advanced to 65 feet in April 2003. Contaminants were found in the groundwater and soil samples <br /> collected at this time. EHD contacted AGE on May 9, 2003, June 25, 2003, November 24, 2003, and December 8, 2003, to <br /> discuss the pending report. No report was submitted to EHD. <br /> Margaret Lagorio sent a letter to Mr. Khaled Anber on December 31, 2003, telling Mr. Anber to submit a report of the bore <br /> hole findingAo EHD by March 1, 2004, or a referral to the San Joaquin County District Attorneys office and/or the Central <br /> Valley Regional Water Quality Control Board for enforcement may be made. The report should include a work plan for <br /> further site investigation. The letter urged Mr. Anber to respond to the Cleanup Fund and provide requested <br /> documentation so that Mr. Anber can be reimbursed for corrective action costs. <br /> Today I spoke to Mr. William Little at Advanced GeoEnviron mental, Inc. (AGE). Mr. Little said that AGE has a letter for Mr. <br /> Anber to review concerning reimbursement from the Cleanup Fund. AGE has tried to contact Mr. Anber but Mr. Anber has <br /> not responded. <br /> Today I called Mr. Anber. He is coming to Stockton on Thursday, February 5, 2004, and will go to AGE. Mr. Anber is very <br /> concerned about the property across the street called Jay Mar Exxon. I told Mr. Anber that the site has gone to the District <br /> Attorneys Office and is being cleaned up. Mr. Anber said that EHD told him to get the tanks removed and then he can <br /> take his time cleaning up the site. Mr. Anber doesn't understand why there is a rush to clean up the site. The site has <br /> been dirty for years and nothing was done. Mr. Anber said he wants to clean up the site but he is struggling financially. <br /> Mr. Anber said he is not dragging his heels, but he has to pay his bills. He does not want this case to go the District <br /> Attorneys Office. I told Mr. Anber to get in touch with AGE. It takes time to prepare a work plan and EHD wants the work <br /> plan by March 1, 2004. 1 told Mr. Anber that I am willing to go to AGE on Thursday to discuss what needs to be done.
