Weber Street, Stockton, to discuss your failure to investigate the extent of
contamination from the former leaking underground storage tanks (UST's)that were operated at the
above referenced site. At that meeting you agreed to submit the analytical results of the soil samples
collected from beneath the UST's when they were removed by March 11, 2003, submit a work plan for
further investigation of the site by April 4, 2003, complete the work proposed in the work plan by May 4,
2003, and submit a report of the work completed by June 22, 2003. You met the compliance dates for
submitting the UST removal sample result, submitting the work plan and performing the work proposed in
the work plan.
Three borings were drilled in April 2003 and soil and groundwater samples were collected and analyzed
for contaminants. EHD has been informed that contaminants were found in some of the soil samples and
all of the groundwater samples, but a report of these results and the work completed has not been
submitted to EHD. A report of the work must be submitted to EHD by March 1, 2004, or a referral to the
San Joaquin County District Attorneys office and/or the Central Valley Regional Water Quality Control
Board for enforcement action may be made. The report should include a work plan for further site
investigation (showing the UST and dispenser area)which includes the installation of monitoring wells.
EHD has received copies of letters from the State Water Resources Control Board Cleanup Fund finding
your claim to be ineligible because you have not responded to their requests for additional
documentation. EHD strongly urges you to respond to the Cleanup Fund so that your corrective action
costs are reimbursed.
If you have any questions contact me at(209)468-3449.
Donna Heran, REHS, Director
Environmental Health Department
Margaret Lagorio, Supervising REHS
Unit IV
c: Jim Barton—CVRWQCB
David Irey—SJCADA
William Little-AGE
