El Dorado St. <br /> Stockton, CA <br /> A complaint has been received by this office alleging that you are responsible for a public health violation(s) <br /> (California Health and Safety Code,Division 20;Title 23,California Code of Regulations, Division 3). The nature <br /> of the violation(s)is(are)listed below: <br /> The San Joaquin County Environmental Health Department(EHD)received a complaint regarding the <br /> above referenced location. The complaint alleges abandoned underground storage tanks on the property. If <br /> so,you are in violation pursuant to: <br /> California Health and Safety Code Section 25298(a): <br /> No person shall abandon an underground tank(UST)system or close or temporarily cease operating <br /> an underground tank(UST)system,except as provided in the section. <br /> California Code of Regulations Section 2670(b): <br /> The temporary closure requirements of section 2671 shall apply to those underground storage tanks <br /> in which the storage of hazardous substances has ceased but the underground storage tank will again <br /> be used for the storage of hazardous substances within the next 12 consecutive months. <br /> California Code of Regulations Section 2670(e): <br /> During the period of time between cessation of hazardous substance storage and actual completion of <br /> underground storage tank closure pursuant to section 2671 or 2672,the applicable containment and <br /> monitoring requirements of Articles 3 or 4 shall continue to apply.The time period between cessation <br /> of hazardous substance storage and application for temporary or permanent tank closure shall not <br /> exceed 90 calendar days.Closure shall be completed within a reasonable time period as determined <br /> by the local agency. <br /> Please provide an application(s) for underground storage tank temporarily or permanent closures by February 06, <br /> 2006. <br /> If further complaints are received,an investigation will be made which may result in legal action being taken against <br /> you. <br />
