On July 9, 2004 PHSEHD further informed Mr. Patel in a letter that it appeared to the agency <br /> that Mr. Patel had chosen to have the motel water supply well tested. PHSEHD again informed <br /> Mr. Patel that the consultant retained must be a licensed professional engineer or geologist and <br /> that a workplan must be submitted to and approved by PHSEHD prior to the work being <br /> conducted. <br /> On July 28, 2004 the water supply well was sampled by Precision Enviro-Tech Analytical at the <br /> request of the property owner, Mr. Patel. We understand that PHSEHD personnel were present <br /> to witness the sampling. The water sample was analyzed for purgeable organic compounds using <br /> USEPA Test Method 524.2, total petroleum hydrocarbons as gasoline and diesel using USEPA <br /> Test Method 8015M. All reported analytical laboratory results were below analytical method <br /> detection limits. A report of findings was submitted to PHSEHD by High Tech Enterprises on <br /> November 1, 2004. Mr. Edward Finucane signed the report and concluded that the St. Francis <br /> Motel water well was completely free of any dangerous contamination. <br /> On November 8, 2004 PHSEHD again notified Mr. Patel that the conclusions submitted for <br /> clearing the St. Francis Motel water supply well must be signed by a California licensed engineer <br /> or geologist. PHSEHD also directed Mr. Patel that any recommendation from the signing <br /> professional must have a migration evaluation and determination stating that"no threat exists to <br /> the drinking water and that no further investigation is needed". <br /> Mr. Finucane submitted a letter to PHSEHD dated December 4,2004 which refuted the basic <br /> requirements that PHSEHD had directed Mr. Patel to complete in order to rescind Order to <br /> Vacate of Room 108. In this letter to PHSEHD,Mr. Finucane reported that he did not possess the <br /> California professional licenses that entitled him to sign a report required by PHSEHD for site <br /> closure. <br /> PHSEHD responded to Mr. Finucane's letter dated December 4, 2004 in a letter dated January <br /> 10, 2005. In this letter,the position of PHSEHD requirements to complete the investigation was <br /> reiterated. A letter from PHSEHD dated January 28, 2005 was sent to Mr. Patel that again <br /> reiterated the requirements that must be met prior to PHSEHD rescinding the"Notice to Vacate" <br /> for Room 108. <br /> Main\Environmental\.St.FrancisMotel\Report\Report05252006.wpd 6 <br />
