combined single limit each occurrence for bodily injury and property damage,which provides <br /> for the following: <br /> (i) Such insurance is primary,without right of contribution from other <br /> insurance which may be in effect. <br /> (ii) Such insurance shall not be invalidated by the acts or omission of <br /> other insureds. <br /> (iii) Notice of Modification or Cancellation. <br /> (iv) Trimark and Shea shall be named as an additional insured. <br /> (v) Such insurance shall contain a severability of interest clause. <br /> (d) Intentionally Deleted <br /> (e) Professional liability insurance in the amount of Two Million Dollars <br /> ($2,000,000) per claim and in the aggregate for any Shell Agent performing work on the <br /> Property,which provides for the following: <br /> (i) Notice of Modification or Cancellation. <br /> (ii) Trimark and Shea shall be named as an additional insured. <br /> Prior to entering the Property, Shell shall obtain, and shall cause Shell Agents who will <br /> have access to the Property to obtain a properly completed certificate of insurance executed by <br /> an authorized representative of the insurer or insurers as satisfactory evidence of any insurance <br /> required under this Section 4. <br /> (f) Those entities and persons named below shall be included as an additional <br /> insured under the coverage specified above with the following provisions included within each <br /> applicable policy or an endorsement to the policy, a certified copy of which shall be delivered to <br /> Trimark and Shea upon Trimark's or Shea's request: <br /> Coverage afforded by this Policy shall also apply to Trimark <br /> Communities, LLC,and Shea Mountain House, LLC and each <br /> of their members,managers and affiliates and all of their <br /> respective officers,directors, shareholders, and employees and <br /> all of their respective successors and assigns, as additional <br /> insureds,but only with respect to legal liability or claims <br /> caused by, arising out of or resulting from the acts or omissions <br /> of the named insured or others performing acts on behalf of the <br /> named insured. <br /> (g) Each insurance policy shall: (i) except as otherwise approved in writing by <br /> Trimark and Shea, be issued by insurance carriers licensed and approved to do business in <br /> Site Access Agreement(Mountain House-Neighborhood C&D) <br /> Page 6 of 11 <br /> 94205 v] <br />
