Box 5155 <br /> San Ramon, CA 94583 <br /> CLOSURE REQUEST, FORMER UNOCAL BULK PLANT, PORT OF STOCKTON, <br /> SAN JOAQUIN COUN'T'Y <br /> We have reviewed KEI's 6 July 1994 Case Closure Report on the former Unocal Bulk <br /> Plant Number 0950 in Stockton. I concur with KEI's findings that the petroleum- <br /> contaminated soils related to Unocal's underground storage tank operations have been <br /> remediated, the remaining residual contamination in monitoring well (MW) 3 is likely <br /> the result of operations at the adjacent facilities, and the chlorinated and petroleum <br /> hydrocarbon contamination in MW 5 also is likely caused by other terminal operations. <br /> I also concur with KEI's recommendation that no further investigation or ground water <br /> monitoring is warranted at the site. <br /> Based on the information provided, Board staff has determined that appropriate <br /> response actions have been completed, acceptable remedial practices were implemented, <br /> and at this time, no further investigation, remedial or removal action or monitoring is <br /> required at this site. <br /> Nothing in this determination shall constitute or be construed as a satisfaction or release from <br /> liability for any conditions or claims arising as a result of past, current, or future operations at <br /> this location. Nothing in this determination is intended or shall be construed to limit the rights <br /> of any parties with respect to claims arising out of or relating to deposit or disposal at any other <br /> location of substances removed from the site. Nothing in this determination is intended or shall <br /> be construed to limit or preclude the Board or any other agency from taking any further <br /> enforcement actions. <br /> This letter does not relieve Unocal of any responsibilities mandated under the California Health <br /> and Safety Code and the California Water Code if existing, additional, or previously-unidentified <br /> contamination at the site causes or threatens to cause pollution or nuisance or is found to pose a <br /> threat to public health or water quality. Changes in land use may require further assessment and <br /> mitigation. <br />
