(Wayne Perry) on behalf of Equilon Enterprises LLC dba Shell Oil Products US <br /> (Equilon) for the bulk fuel terminal located at 3515 Navy Drive in Stockton, San Joaquin County <br /> (Site). The Annual Report summarizes field activities and monitoring data associated with the first <br /> quarter and third quarter 2018 groundwater monitoring events conducted in accordance with the <br /> 1 October 2015 Final Revised Monitoring and Reporting Program No. R5-2015-0820(the MRP). <br /> Central Valley Water Board staff has the following comments regarding where Equilon did not <br /> conduct third quarter 2018 groundwater monitoring and reporting in accordance with MRP <br /> requirements: <br /> 1. Required Action#5 of the MRP states "All technical reports submitted by the Dischargers <br /> shall include a cover letter signed by the Dischargers, or an authorized representative, <br /> certifying under penalty of law that the signer has examined and is familiar with the report ad <br /> that to their knowledge, the report is true, complete, and accurate." The Annual Report does <br /> not include a cover letter signed by Equilon. <br /> 2. The Sample Quality Control section of the Annual Report states: <br /> "Trip Blank, Field Blank, Equipment Blank, and Duplicate sample were obtained for quality <br /> control purposes (Table 4A). Laboratory analyses of the Trip Blank, Field Blank, and <br /> Equipment Blank indicated that TPH-G, benzene, MTBE, and TBA were not detected in any <br /> of those samples." <br /> Central Valley Water Board staff has reviewed the entire Annual Report, including all field <br /> sheets and lab reports, and has found no indication that any trip blanks, field blanks, or <br /> equipment blanks were actually collected during the September 2018 monitoring event. <br /> Finding #9 of the MRP states: <br /> "Any person failing or refusing to furnish technical or monitoring program reports as required <br /> by subdivision (b) of Section 13267 or falsifying any information provided therein, is guilty of <br /> a misdemeanor and may be liable civilly in accordance with subdivision (b)." <br /> ('nntin---rc4rhmifial of monifonng reports 1nihich fail in menf AApP ronllirarr�or1tS and/nr innl/IrIn <br /> 411 LV III - IY/I VNUI/VII VI t ,.,., //IVIN4Ci <br /> falsified information will result in the issuance of a Notice of Violation outlining recommended <br /> administrative civil liabilities (ACLs) for continued non-compliance. <br /> KARL E.
