Ms. Carol Campagna -2 - 17 September 2009 <br /> Shell Stockton Terminal 0 46 <br /> of the system..."Although a report of the AS/SVE pilot test will be prepared in November, <br /> Shell is still required to provide an update of operation of the system so that issues with the <br /> system could be identified and resolved before the test period is terminated. Because the <br /> AS/SVE pilot test is due to be concluded before the next Semiannual Report, Central <br /> Valley Water Board staff will contact you shortly after you receive this letter to schedule a <br /> site visit to observe and be briefed on the performance of the AS/SVE pilot test. <br /> 2. Section 3.4 of the Semiannual Report discloses that the GWE was non-operational due to <br /> delays with off-hauling the extracted water and a malfunctioning flow totalizer. MRP No. <br /> R5-2005-0810 requires Shell to notify the Central Valley Water Board within 48 hours of <br /> any unscheduled shutdown of the groundwater extraction system. The MRP is an order <br /> issued by the Executive Officer of the Central Valley Water Board. Failing to notify staff as <br /> required constitutes a violation of this order and in accordance with Section 13268 of the <br /> California Water Code could subject Shell to administrative civil liability. Central Valley <br /> Water Board staff will not recommend enforcement for this occurrence.
