These are voluntary deed <br /> restriction agreements with owners of property who propose building residences, <br /> schools, hospitals, or day care centers on property that is"on or within 2,000 feet of a <br /> significant disposal of hazardous waste". <br /> California has a statutory and administrative procedure under which the California <br /> Department of Health Services (DHS) may designate real property as either a <br /> "Hazardous Waste Property"or a"Border Zone Property" pursuant to California Health <br /> Safety Code Sections 25220-25241. Hazardous Waste Property is land at which <br /> hazardous waste has been deposited, creating a significant existing or potential hazard <br /> to public health and safety. A Border Zone Property is one within 2,000 feet of a <br /> hazardous waste deposit. Property within either category is restricted in use, unless a <br /> written variance is obtained from DHS.
