Ry
MR. ROBERT L. NIBLACK
May 25 , 1988
Page 2
to the successful completion of this ground water investigation,
and requesting SJCEH to grant a variance or waiver regarding these
setback criteria.
Bob, I am certain you must understand the frustration of Lin-
coln Properties, Ltd. Their attempted compliance with the investi-
gations required by your office, and desired by SJCEH, is being
prevented by inconsistent requirements by the two agencies. We
would request your assistance in resolving this issue in a manner
acceptable to all concerned, as rapidly as possible. Lincoln Prop-
erties, Ltd. , is incurring additional expense as a result of the
delays. In addition, such delays will make it extremely difficult
to meet the deadlines imposed by your office for submission of the
required report. We appreciate your assistance thus far in permit-
ting installation of the wells to take place, but this problem does
need to be resolved for the soil sampling.
L-H is currently in the field proceeding with installation of
the permitted monitoring wells . In addition, Lincoln Properties,
Ltd. , has also not received permission from Chevron USA, Inc. , for
access to the existing monitoring well located near Pacific and
Benjamin Holt. Realistically, unless these issues are resolved
prior to May 31 , the ground water investigation report will not
include data from these sources .
Please call if you should have any questions and, again, thank
you for your cooperation and assistance.
Very truly yours,
JEANNE M.
