Smith of Lincoln Properties , Limited, in which
you approve Lincoln Properties' work plan. We note that in
this letter you state that the technical report is due to the
Regional Board by June 24 , 1988 . Also enclosed you will find
a March 21 , 1988 letter to me from Gerry S. Nakano from
Leedshill-Herkenhoff, Inc. In this letter, Gerry states that
while they will make every effort to complete the report
prior to June 24 , that in view of anticipated scheduling, it
may not be possible to meet the June 24 date. In fact, Gerry
Nakano feels the most realistic date we could hope for would
be a July 24 , 1988 date.
I wanted to put you on notice as soon as possible of
this potential inability to meet the deadline imposed by the
Regional Board. As Gerry states in his letter, we will make
every effort to meet your imposed deadline. However, when we
agreed initially to a time period, it was four months from
the "start up" date. Since that time, negotiations on the
contents of the technical report and obtaining approval of
j the Regional Board of that report have taken approximately a
month. Consequently, the start up date was not until March
21 , 1988 . We will continue to keep your office posted on the
progress of the technical report and perhaps will have a
better understanding of the timing required after investiga-
