1 the Consent Decree to develop and implement an appropriate site investigation and remediation <br /> 2 program by coordinating their suggestions and proposals, including those involving any interim <br /> 3 actions,through the Lead Agency at the Site so that they may be properly addressed by the <br /> 4 Settling Parties with any resulting disputes resolved by the Special Master and, if necessary, <br /> 5 ultimately by the U.S. District Court. <br /> 6 Comment#3• <br /> 7 Section Addressed: General Comment <br /> 8 Summary of Comment Received: <br /> 9 The Commenter, DTSC, states that the Consent Decree should be modified to <br /> 10 require regular monitoring of the sewer discharge from the dry cleaners to verify that continued <br /> 11 1 releases of Hazardous Substances do not occur. <br /> 12 Settling Parties' Response: <br /> 13 While the Settling Parties believe that the risk of further discharges of Hazardous <br /> 14 Substances occurring as a result of the dry cleaners' operations at the Site has been obviated in <br /> 15 light of the discontinuation of on-site dry cleaning operations at one of the dry cleaning facilities at <br /> 16 the Site and the modernization of the remaining dry cleaning equipment in use at the other dry <br /> 17 cleaning operation at the Site, the Settling Parties believe that regular monitoring of sewer <br /> 18 discharges from the one(1) dry cleaning operation which is still using dry cleaning solvents at the <br /> 19 Site may be appropriate to alleviate any residual concerns and will consider incorporating, subject <br /> 20 to the concurrence by the Lead Agency, such monitoring into the upcoming draft of the Workplan <br /> 21 for the Proposed Remedial Action Plan. <br /> 22 Comment 04: <br /> 23 Section Addressed: Section XIV, Response Related Notices And Communications <br /> 24 Page 24, Lines 25 -28 <br /> 25 Summary of Comment Received: <br /> 26 The Commenter, Department of Toxic Substances Control, requests that all future <br /> 27 notices to DTSC which may be required pursuant to Section XIV of the Consent Decree be <br /> 28 <br /> JOINT SUMMARY OF PUBLIC COMMENTS&RESPONSES REGARDING FIRST FINAL CONSENT DECREE -8- <br /> 0009203.10 10/03/94 Ca 10:43 AM <br />
