1 Comment#7: <br /> 2 Section Addressed: General Comment <br /> 3 Summate of Comment Received: <br /> 4 Several Commenters, all residents in the immediate vicinity of the Site, note that <br /> 5 residents adjacent to Lincoln Center may have been exposed to contaminated soil and groundwater <br /> 6 which could pose a danger to their health and welfare. The Commenter suggests that the Consent <br /> 7 Decree be amended to require inspection of the properties surrounding Lincoln Center and removal <br /> 8 of any contaminants located there. <br /> 9 Settling Parties' Response: <br /> 10 The Consent Decree contains extensive and appropriate provisions to protect the <br /> 1 I public and remediate the contamination at and emanating from the Site. Specifically, the parties <br /> 12 are engaged, under the direct order and supervision of the Federal Court and its appointed Special <br /> 13 Master, in conducting a complete Remedial Investigation to ascertain the nature and extent of the <br /> 14 contamination wherever it may have come to be located. A draft of the Remedial Investigation <br /> 15 report shall be provided to the Public Agencies for review and made available for public comment. <br /> 16 Consistent with the NCP, the Permanent Injunction requires that the Settling Dry Cleaning <br /> 17 Defendants analyze the results of the Remedial Investigation and prepare a comprehensive <br /> 18 Feasibility Study which will analyze all of the endangerments and evaluate the potential remedies <br /> 19 and solutions that are available for the Site. The Settling Dry Cleaning Defendants are then <br /> 20 required to develop a proposed Remedial Action Plan that is subject to delivery and review by the <br /> 21 appropriate government agencies and the Special Master in this action. The proposed Remedial <br /> 22 Action Plan will also be made available for public comment and evaluation prior to its submission <br /> 23 to the Federal Court for approval. After a thorough review of the proposed Remedial Action Plan <br /> 24 and the public and governmental comments, the Court will select and direct the most feasible, <br /> 25 effective and appropriate means available to properly abate the endangerments, if any,to the health <br /> 26 or the environment resulting from the contamination at or emanating from the Site. <br /> 27 <br /> 28 <br /> JOINT SUMMARY OF PUBLIC COMMENTS&RESPONSES REGARDING FIRST FINAL CONSENT DECREE -13- <br /> 0009203.10 10/03/94 ril 10:43 AM <br />
